Migori high court today gave IEBC five days to avail ballot boxes in the court ready for a recount and scrutiny for Nyatike constituency MP race..

Justice Anthony Murima gave the orders today which gave Fredrick ‘Odiso’ Ogenga, who lost on Independent ticket, a first win against Tom Odege who won on ODM ticket.

The court also ordered for KIEMS gadgets used in the constituency to be availed from Nairobi for scrutiny.
Ogenga was represented in Migori High Court by lawyer Steve Biko Osur who stood in for lawyer Tom Ojienda.

Osur said today they served Odege lawyers and IEBC official led by Nyatike RO Wesley Rotich with copies of the petition.

“Ballot materials mainly KIEMS machines and ballot boxes were ordered to supply in the court. The boxes will be availed in the next five days,” Osur said.

The lawyer said they have “damning allegations” that showed the election of Odege was not free and fair as the process marred by fraud and massive irregularities.

“We seek to annul the election of Odege on account on irregularities that are imminent, there are several infractions against the law and fraudulent transactions against our client,” Osur said.
