The Migori High Court on Tuesday started hearing the only election petition filed in Migori county following the August 9 general elections.

West Kanyamkago MCA Peter Mijungu’s win on Independent ticket has been challenged by the ODM candidate Bernard Omondi Gwonyo.

Gwonyo, as the petitioner challenged the  484 win margin between them saying the will of the ward’s voters was subverted pointing the exercise was marred by violence, intimidation, voter’s bribery and attack on his agents.

During the election, a voter at Konduru polling station lost his life over the chaos.

In his petition, which roped in 16 witnesses, Gwonyo said irregularties in about five voting centers “showed a disparity of 1,387 votes which could not be accounted for, this had a great impact in the outcome of the elections.”

“There was an organised scheme by the first respondent (Mijungu) and the second and third respondents (IEBC and Returning Officer) to rig the elections in West Kanyamkago,” Gwonyo said.

He said his petition was set to prove “that because of irregularities, violence and electoral offences i unfairly lost the elections.”

Gwonyo seeks to have the election thrown out as it subverted the will of the people.

The hearing before justice Dickson Onyango continues later today.
