Opere plot to get clerk job back thwarted by assembly’s new application

Attempts by beleaguered Migori assembly clerk Tom Opere to get his position back as hit a snag by his employer’s new court application.

Assembly through lawyer Odhiambo Kanyangi has moved to court  in application to confirm Opere’s suspension dated August 2 this year.

Through lawyer Omondi Abande, Opere on September 26 obtained orders suspending his suspension until his petition against the speaker and assembly is heard and determined.

His deputy Emmanuel Kingwara has been acting in his capacity since his suspension, with assembly arguing that the orders “shall interfere with the operations of the board and county assembly as a whole.”

Assembly filed the application at the Kisumu Employment and Labour Relations Court before Judge Mathews Nduma Nderi, who set an hearing date for December 18.

Opere was suspended for 90 days as the clerk of the assembly and secretary of the assembly service board after allegations from Muhuru Bay MCA Hevron Maira to the board to ‘’enable further investigations into the allegations and other matters pertaining to the performance of your (Opere’s) duties and responsibilities.’’

Maira, on April 30, wrote to the board accusing Opere of abuse of office, professional incompetence and gross misconduct arising from procurement and contracts.

Opere refused to defend himself of the allegations when speaker Boaz Okoth wrote to him on September 9, 2019.
