High Court allows dismissal of Rongo University students

High Court sitting in Migori has allowed Rongo University College to go ahead and dismiss students who participated in strike.

Eight students; Victor Mwango, James Maina, Felix Mosicho, Zachariah Babere, Haron Mutai, Patrick Kabui, Simon Mwangi and Mercy Karim had their case dismissed after they wanted the institution to be stopped from suspending them.

Chief justice David Majanjain his ruling said university is a self governing institution and courts cannot unnecessarily interfere with its internal affairs.

The court said that the internal processes of the institution including disciplinary proceedings are so crucial thus dealt with internally.

The students went to seek for justice at the court claiming that the procedure used by Rongo university to discipline them on 27th August 2014 following a strike was violating article 47 (1) of the constitution.

The students were presented by Neto Otieno and Company Advocates.

According to the suspension letter signed by the principal Samuel Gudu, the students were suspended for 14 days effective from 27th August after they were accused of organizing unlawful demonstration and inciting students.

Gudu directed them to appear before the Rongo University College Disciplinary Committee with either parents or guardians on 9th September 2014 at 10.00 am in the boardroom.

According to the disciplinary action letter signed by the principal on 16th September 2014, three of the students were expelled from the university while five of them were suspended for an year and expected to pay Sh24,000 upon return.
