Judgment on the petition challenging the party nominations of Migori county assembly Members on gender top up has today been given as the court sitting in Rongo Magistrate court.

A total of 2 nominated members of the Migori county assembly have been declared to be illegally in office.

While giving his judgment on the petition filed by nine voters, presiding judge Raymond K.Langat said that the was raised by the Political Party Triburnal which gave another list which was to be harmonised by the ODM party before the names were gazetted.

Langat ruled that the nominees were in office illegal as the party list as null and void.

ODM has now been instructed to gazette the list from tribunal.

However the court has uphold the nomination of Philister Atieno, wife of Migori ODM chair Philip Makabong’o who was nominated to represent the special interest group in the assembly.

The court said Atieno was disabled before being nominated contrary to claims by petitioners.

Here is the full list of affected members: Milicent Akinyi, Agnes Mogesi, Florence Adongo, Lilian Anyango, Asenta Adhiambo, Roseline Adhiambo, Florence Oile, Hellen Halima Omar, Hellen Moraa, Hellen Atieno, Chris Atieno and Maurine Dande.

On his part, the lawyer representing the respondents on the case Christopher Ojwang while speaking to press outside the court room after the judgment he said they are not happy with the ruling hence are contemplating of challenging the judgment in the high court saying the court based their judgment on the decision of the political parties tribunal which they must challenge since they had no idea on the decision.
