Awendo man, 80, sentenced to 30 years for defiling teen

An 80 year old man has been sentenced to 30 years imprisonment after being charged of defiling a 14 year old girl in Mariwa village south Sakwa, Awendo Sub County Migori.

While giving his judgment Rongo Principal Magistrate court Judge Charles Kamau said that the accused person James Pesa Olwande on the 28th of July 2018 intentionally and unlawfully contrary to section 8(1)(2) of the sexual offences act No.3 of 2006 persuaded the minor who is a daughter to the neighbor to his house to go and pick sweet potato before he followed her and defiled her severally.

He said having carefully considered all the evidence in record and having been guided by the relevant principles of law and hard all the plea from all the witnesses and conducted proper investigations, as well as satisfied that the prosecution has proven its case in the principal count beyond reasonable doubt and consequently convinced that the accused person under section 215 criminal procedure code of the offence of defilement contrary to  section 8(1)(2) of the sexual offences act as by law required that warrant his life imprisonment.

He said that it would be a lesson to the rest of the people coming from the areas of Awendo and Rongo where cases of defilement have been on the increase.

The accused person has however been given 14 day to appeal in case they are not satisfied with the ruling of the court.

In the alternative count, the accused person was charged with the offence of committing indecent act with a child contrary to section 11(1) of the sexual offences act and he is expected again to be brought before the court on the 14th of December 2018 for hearing awaiting the judgment later next year.

This comes just few days after Migori County children’s officer Mr.John Odinya warned of infringing on the child’s right saying those who will be found culpable will be dealt with in accordance to the law.
