Ntimaru MCA convicted of rape out on bail, resume work

MIGORI: The convicted Ntimaru ward representative has been released from jail awaiting the hearing and determination of an
appeal he has lodged with the High Court.

Lukas Hura had been found guilty of defiling a 16-year-old girl by a magistrate’s court and sentenced to 15 years.

He was released after depositing Sh100,000 bail and presenting two sureties of Sh500,000 each.

In his appeal, the MCA wants the High Court to re-examine what he submitted as errors in the judgement of the case by the trial magistrate.

Mr Hura submitted that the earlier trial was erroneous on more than 12 issues, which he wants reviewed in his favour, and said there was no evidence that he had actual sexual intercourse or penetrative sex with the complainant.

He argued that the evidence by the Government analyst, which sampled his DNA with that of the complainant and that of her mother, contradicted that of the clinical officer who testified against
him.

He further submitted that the lower court erred in law and facts when it ruled that he was positivelyidentified as the perpetrator of the offense, yet there was no sufficient evidence to prove him so.
