Migori county voters may be facing a possible by-election after three voters moved to court to have governor Okoth Obado’s seat declared vacant.

The three; George Ohuru Bonyo, George Obuye Owuor and Wilson Chacha Caleb through Bosire Gichana and Company Advocates want Obado’s seat declared vacant after he decamped from People Democratic Party (PDP) to Orange Democratic Movement (ODM).

On July 8, Obado publicly decamped when Cord leader Raila Odinga gave him an ODM cap during the homecoming party of Suna East MP Junet Mohammed.

“We hereby do and demand your immediate resignation from the position of the county governor of Migori county,” the three said in letter dated July 15 written to Obado and copied to secretaries of his former party PDP, ODM (both in Orange House and Migori) and Registrar of Political parties.

“We will move to court after seven days if the governor doesn’t reply to our letter,” lawyer Gichana said confirming the letter has been served to all parties.

Omingo Magara, the PDP party leader said next month they will have a meeting to decide on the way forward after the party’s only governor decamped.

According to section 14(5)(e) of the Political Parties Act 2011, Obado ceases to be a member of PDP after decamping and subsequently loses his seat.
