The court has set out ten days for hearing of the murder trial of former Migori Governor Okoth Obado and his aides.
Obado, his personal aides Micheal Oyamo and Caspal Obiero are in court facing trial over the murder of Sharon and her unborn baby.
They denied the charges after they and others not before court are accused of committing the crime on September 3, 2018 at Owade, Homa Bay county.
The ex-governor, his family members and allies are also set to pick a fresh date for hearing of their graft case.
Sharon was found lying in a pool of blood at a thicket in Owade, Homa Bay county. DNA results have proved that the unborn male child was Obado’s. It was a 28 week old foetus at the time it met its death.
Judge Cecilia Githua said she will proceed with the case even after she was transferred to Murang’a and fixed for hearing from July 17, with 18 witnesses to go.
“I thought I will escape this matter after my transfer…But its okay we will continue from where we left,” she said as quoted by a national daily.
The case will be heard from 17 to 21 July, and 24 to 28 July and said all parties should cooperate to ensure the matter is concluded.
The office of the Director of Public Prosecutions undertook to ensure they have witnesses in court on the days that have been set aside but the last time the matter was in court, the trial failed to kick off.
The defense counsels, lawyers Kioko Kilukumi and Rodgers Sagana said they were not supplied with documentary evidence being relied on by a witness from the National Transport and Safety Authority.
The witness had already taken the stand but was stood down after said they were not served with the document and it also failed to satisfy the requirements of the Evidence Act.
Baraqo Baji, who is the prosecution’s 25th witness, was referring to a document detailing the registration of a motor vehicle believed to have been used during the abduction of the late Sharon Otieno.
The vehicle is a Toyota Fielder KCL 481K. He was in court in July last year
The witness at the time worked under the NTSA Registration Department.
From the NTSA record, the KCL car was imported by one Saidi Kalu. Its origin is Japan and it was registered on 28 April 2017.
On August 13, 2018, the vehicle was transferred to one Adhiambo Oloo Olivia. The registration details of the vehicle remain under her name to date. The defense was opposed to the documents citing issues of certification.
