Suna West: Masara supporters celebrate minor victory against Ndiege’s petition

Suna West MP Peter Masara earlier this week celebrated a decision by High Court to deny former MP Joseph Ndiege orders in election petition.

Drama unfolded at the Migori High Court after the court adjourned an election petition making the respondents supporters to elicit celebration that the case has been dismissed.

Justice Anthony Murima said that the case has been adjourned to a later date that will be set by the court once the new judge to hear the case comes to the station.

Justice Murima adjourned the case citing lack of enough time to hear the case since he has been transferred to Kitale and the Kitale based judge Hillary Chemutai will come and a date will be set for the hearing of the case to begin.

The adjournment of the case made the respondent Peter Masara and his supporters pour on the streets of Migori terming the adjournment as a dismissal of the case by the Justice Anthony Murima.

The petitioner’s lawyer Charles Midenga said that the respondent’s supporters are acting out of ignorance as know case has been dismissed saying that the judge only adjourned the case since the presiding judge is being transferred to Kitale and it will start when the judge is at the Migori High Court.

The same lawyer’s sentiments were echoed by the petitioner immediate former member of parliament for Suna West Joseph Obiero Ndiege who termed the move by his opponents as mere ignorance and lack of knowledge of the legal aspects that pertain to petitions and elections and insisted that the case will proceed when the new judge
