Before settling for hearing dates during today’s ruling, Justice Jessie Lessit asked the prosecution how many witnesses they had.

“My lady we will be calling 30 witnesses,” said lead prosecutor Jacob Ondari.

Ondari however said they had recorded statements from 24 witnesses in the case that attracted attention internationally.

“We hope to supply in due time statements of the other witnesses who are remaining,” Ondari said.

Following the murder, police arrested Governor Obado, his two aides Oyamo and Obiero alongside former Kanyidoto MCA Lawrence Mula.

Another aide Elvis Omondi was arrested but was later released.

Obado was also released on shs. 5 million bail with his co-accused Oyamo and Obiero being denied bail.

Justice Lessit said the court relied on evidence to determine the issuance of bail to the three suspects.

“As for the first accused [Obado] according to Mr. Ondari the prosecution will be relying on circumstantial evidence.” Justice Jessie Lessit said

She added: “There has been reference made to evidence in the investigating officer’s affidavit. At this stage that reference is based on conjecture and I find it is dangerous to use it now as a ground to deny bail…”

Sharon Otieno was found dead in Kodera forest in Homa-Bay county with the postmortem report revealing she suffered several stab wounds.

The then Rongo University student died following her reported abduction together with Nation Reporter Barack Oduor.

According to Oduor, he wrestled the abductors before jumping off a moving vehicle and escaped on foot before he was rescued by a good Samaritan.

Police later recovered a vehicle believed to have been used in the abduction of the two that led to the death of Otieno.

The case will be heard between 6th and 17th of May next year.
