ODM Plans To Win Back West Kasipul MCA After Winning Petition From Ind Candidate

Oyugis law Court on Wednesday nullified the election of Vickins Bondo as the duly elected MCA for West Kasipul Homa Bay County.

This is after his competitor Peter Ongili lodged the case disputing his election to represent the people of the ward in the  in the August 9 2022 General elections.

According to Ongili, the elections were not held in a free and fair and the whole process lacked transparency.

Bondo who vied as an independent candidate was declared the winner after garnering 4,041 votes against Ongili of ODM who got 3,890 votes.

According Judge Bernard Owansa who presided over the case directed the Independent Electoral and Boundaries Commission to conduct a fresh elections as stipulated in the law.

Omwansa noted that there were 78 ballot papers which were not counted during the exercise despite being used.

Meanwhile Homa Bay Town West ward MCA Samwel Obusna got a sigh of relief after Homa Bay High Court dismissed an petition challenging his August 9,2022 General elections win.

Former area MCA Isaac Ouso Nyandege who vied on ODM ticket and Solomon Ogolla alleged that the elections were not held in a transparent way and were marred with numerous irregularities.

The petitioners requested for the re count of votes used during the exercise and scrutiny of form 36As

Obuana who vied as an independent candidate garnered 2369 against Nyandege who got 2249 of the total votes cast during the exercise.

The petitioners singled out Magare polling station where they alleged of numerous malpractices during the exercise.

According J.M Mwazia,the judge presided over the case there no enough evidence which were presented before the court by the petitioners which lead to the nullification of the election.

He said Omuono the elections were conducted in a transparent manner and according to the stipulated law

During cross examinations, Homa Bay Returning Officer Gregory Ouko told the court that the IEBC officials who carried out the exercise did an exemplary job accordance with the law.
