Why grabbing of Clement Ayungo family points to a string of Chinese, local miners tension

The Wednesday demonstration by over 200 gold miners and residents of Masara town is just an iceberg of how local administrators are colluding with Chinese nationals to swindle innocent people.

The angry crowd demanded redress from Suna Lower chief Yogo Tumbo after he failed to turn up at a meeting he had called in his office between the family of the late Mzee Clement Ayuongo.

Ayungo’s family spokesman, John Riana said despite the late Mzee Ayungo who passed in 1979 having three wives, over ten children bring up to 32 families in his 42 acres of land a fake succession and sale was drafted.

Documents seen by Migori News showed creation of death certificate and  succession on the same day, days after a Sh2.5million sale of ten acres of land between Duncan Ndiro, Ayungo’s eldest grandson to sell the land to Odemo Dancan Anyango and Li Shisheng on September 19, 2017.

“The agreement were fraudulent, it ended up grabbing over half of entire 42 acres of family land, and affecting our family graves and families. The buyers moved to a section not included in the sale,” Ndori said.

Ndori and Riana said they will move to court to seek redress.

This comes after Nyatike Mineral Marketing Co-operative Society filed the petition number 12 of 2019 at Migori Environment and Lands Court.

The society, in a similar way filed and won a case against   Cabinet Secretary- Ministry of Petroleum and Mining, Director of Mines and Geology, businessman Khalif Abdi Hassan , Nuo Kenya Company Limited, Ready Consultancy Company Limited Attorney General.

They complained against invasion of a public land by the respondents, non-payment of royalties, Illegal process of licences and land degradation at the Macalder Matanda mines.

In another case, Nyatike MP Tom Odege also moved in the same court against Chinese miners invasion in the same land.

He also sued Cabinet Secretary for Petroleum and Mining, Director of Mines, Lijin Mining Company (A chinese owned company) and Attorney General.

The legislator got orders to stop the mining in the area.

On September last year and multi-agency team led by Migori county commissioner Joseph Rotich closed over 40 illegal mining and processing plant in the county.

Firms associated with top county politicians and elites including several owned and managed by Chinese nationals were affected.
